Part K — Witnesses and commissions

Rule 89. Examination in camera

Chapter XII · Examination of witnesses and issue of Commissions

89.1 The rule

The Appellate Tribunal may in its discretion examine any witness in camera.

89.2 What it does

Rule 89 lets the Bench take a witness's evidence with the public excluded. It is a courtroom power about who is in the room while the witness speaks; it is not a confidentiality order, and it does not by itself keep the deposition from being seen or published afterwards.
