Rule 27. Calling for records

Chapter III · Institution of appeals — Procedure


27.1 The rule

On the admission of appeal, the Registrar shall, if so directed by the Appellate Tribunal, call for the records relating to the proceedings from the respective Bench of Appellate Tribunal or adjudicating authority and retransmit the same at the conclusion of the proceedings or at any time.


27.2 What it does

Rule 27 is how the authority's own file comes before GSTAT. The Registrar issues the requisition, but only on a direction of the Bench — there is no automatic transmission of the record on the filing of an appeal, and no power in the Registrar to call for it on his own.
