Part E — The hearing
Rule 49. Procedure for filing of and disposal of interlocutory application
Chapter V · Hearing of Appeal
49.1 The rule
The provisions of the rules regarding the filing of interlocutory applications shall, in so far as may be, apply mutatis mutandis to the filing of applications under this rule.
49.2 What it does
Rule 49 is a residual rule. Rule 29 already prescribes the machinery for seven named categories of interlocutory application filed in a pending matter; r.49 extends that same machinery, so far as it can be made to fit, to every other application a party makes once the appeal is on foot — leave to produce additional evidence, continuance after death, restoration, return of documents, and the rest.
